Terms of Service

Face2Name provides tools for childcare organizations to enroll children, manage rooms and classes, record consent, and verify children during arrivals, dismissals, and room transitions. The Service is an aid to an organization’s own safety procedures.

The Service is intended for authorized staff and administrators of childcare organizations. You must provide accurate account information and keep your credentials (including PINs) confidential. You are responsible for activity that occurs under your account.

• Obtaining and maintaining all legally required parental or guardian consent before uploading children’s information, including photos and consent documents.
• Ensuring the accuracy of children’s records, rosters, and contacts.
• Complying with all laws applicable to your operations, including childcare licensing, staff-to-child ratio, and privacy requirements.
• Configuring appropriate user roles and access within your organization.

You agree not to:

• Use the Service for any unlawful or unauthorized purpose.
• Upload data you are not authorized to share, or infringe the rights of others.
• Attempt to access another organization’s data, or probe, disrupt, or reverse-engineer the Service.
• Interfere with the integrity or performance of the Service.

Paid plans are billed through our payment processor (Stripe) on the terms presented at purchase. Unless stated otherwise, subscriptions renew automatically until cancelled. You may cancel from the web dashboard; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. We may change pricing on prospective notice.

Our handling of information is described in our Privacy Policy. For personal data that we process on your behalf as a processor, a separate data processing agreement may apply and is available on request. You retain ownership of the data you submit.

Face2Name assists with, but does not replace, the professional judgment and supervision of childcare staff. The Service does not guarantee the safety, location, or accounting of any child, and must not be relied upon as the sole means of supervision or headcount. You remain solely responsible for the care and supervision of children and for compliance with applicable safety and ratio requirements.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any warranty that the Service will be accurate, complete, uninterrupted, error-free, or free of defects, to the maximum extent permitted by law. Without limiting the foregoing, KTEX DIGITAL LLC does not warrant that any attendance record, roster, headcount, verification, notification, or other output of the Service will be accurate, current, or complete at any given time, and such outputs may be delayed, incomplete, or incorrect due to factors including connectivity loss, device or sensor issues, user error, or software defects.

To the maximum extent permitted by law, KTEX DIGITAL LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to the Service. This limitation applies to any claim of any kind, including claims arising from or related to bodily injury, death, or property damage allegedly caused or contributed to by an inaccurate, delayed, incomplete, or missing attendance record, roster, headcount, or verification generated or displayed by the Service, or by any other malfunction, outage, or defect of the Service, regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if KTEX DIGITAL LLC has been advised of the possibility of such damages. As stated in Section 7, the Service is a supplementary aid only, and you remain solely responsible for the physical supervision, headcount, and safety of children in your care. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months before the claim.

You may stop using the Service and delete your organization at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Upon termination, provisions that by their nature should survive will survive.

We may update these Terms from time to time. We will post the updated version with a new effective date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the state of Illinois, without regard to conflict-of-laws principles.
